Terms of service

Last updated: [date]

These terms are the agreement between you and us when you use Kevlo, its website, a trial or a paid plan. Please read them, in particular the sections on AI output, disclaimers and liability. By using Kevlo you accept them; if you don't, don't use Kevlo.

Draft. Items in [square brackets] are filled in before launch, and the whole text is reviewed by a lawyer before Kevlo is sold. Nothing on this page limits rights you have under mandatory law.

1. Who we are

Kevlo is offered by [company name], [address], registered with the Netherlands Chamber of Commerce (KvK) under number [KvK number], VAT number [VAT number] (“Kevlo”, “we”, “us”). You can reach us at [support email].

2. Definitions

3. Who can use Kevlo

You must be at least 18 and able to enter into a binding agreement. If you use Kevlo for a company or other organisation, you accept these terms on its behalf and confirm you are allowed to do so; “you” then also means that organisation.

4. Your licence

While your trial or subscription is active, we give you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on the number of Macs your plan allows. You may not:

The App, the website and everything in them except your content remain ours or our licensors'. These terms give you no other rights.

5. Trial, subscriptions and payment

Refunds are covered by the refund policy.

6. Your Claude provider and its costs

Kevlo does not include access to Claude. You connect your own Claude provider, and everything your AI employees use is billed by that provider to you, under its own terms, prices and usage policies. You are responsible for your account there, its security, its costs and following its rules. Kevlo shows estimated costs per task and lets you set budgets, but these are aids only: cost figures may differ from your provider's invoice, and you remain responsible for all spending on your account, also if a budget or limit in Kevlo does not stop work in time.

The same applies to other services you connect, such as Microsoft 365, Outlook, Teams, GitHub or Obsidian. We are not responsible for third-party services, their availability or what they do with your data.

7. AI output and your responsibility

AI employees are software, not people. Their Output can be wrong, incomplete, outdated, biased, inconsistent or unsuitable for your purpose, even when it looks confident. The same instruction can give different results. AI employees can misunderstand you, get stuck, fail, or do something you did not intend.

8. Acceptable use

You may not use Kevlo, or let your AI employees be used, to break the law; harm, harass or deceive people; send spam; infringe intellectual property or privacy; break into systems; create malware; or act against the usage policies of your Claude provider. We may suspend your licence if we have good reason to believe you do.

9. Your content

Your content belongs to you, as far as the law allows. It is stored on your Mac; we do not receive it and cannot recover it if it is lost. You are responsible for your content, for having the rights to use it, and for keeping backups. You confirm that your content and the way you use Output do not break the law or anyone's rights.

10. Feedback

If you send us ideas or suggestions, we may use them freely, without paying you or naming you.

11. Updates and changes to the Services

We may update, change or remove features, and some features may be marked as experimental. We will not, during a paid period, remove the core of what your plan offers without offering a fair alternative or a pro-rata refund. Updates can be required to keep using the App.

12. No warranty

To the fullest extent the law allows, the Services and all Output are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, security and non-infringement.

In particular, we do not promise that Kevlo or its AI employees are reliable, accurate, complete, uninterrupted, error-free, secure or free of harmful components; that they will do what you ask or what you expect; that costs shown are exact; or that the Services will work with every Mac, Claude model or third-party service. You use Kevlo and its Output at your own risk.

13. Limitation of liability

To the fullest extent the law allows:

These limits do not apply to damage caused by our intent or deliberate recklessness, to death or personal injury caused by our negligence, or to any other liability that cannot be limited by law. If you are a consumer, they do not affect your mandatory rights under the law of the country where you live.

14. Indemnity

If you use Kevlo for a business, you will compensate us for claims, damages and reasonable costs, including legal fees, that arise from your content, your use of Output, actions you approved, or your breach of these terms or the law.

15. Force majeure

We are not responsible for failures or delays caused by events outside our reasonable control, such as outages of Claude providers, hosting or payment services, internet failures, attacks, strikes, government measures or natural disasters.

16. Suspension and ending the agreement

You can stop at any time by cancelling. We may suspend or end your licence, after a warning where reasonable, if you seriously or repeatedly break these terms, do not pay, or use Kevlo in a way that creates risk for us or others. Sections that by their nature should continue after the end, such as 7, 9 and 12 to 19, remain in force.

17. Changes to these terms

We may update these terms. We tell you about important changes by email or in the App at least 30 days before they apply. If you do not agree, you can cancel before then; continuing to use Kevlo after that means you accept them.

18. Law and disputes

Dutch law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Disputes go to the competent court in [city], unless you are a consumer and the law gives you the right to go to the court where you live. If you are a consumer, you keep the protection of the mandatory law of the country where you live. Please contact us first; most problems are solved by talking.
